Content_____: LEGAL ADVICE ON EMPLOYMENT, RESIDENCE PERMIT AND OBTAINING PROPERTY

There are two alternatives to settle here. The first is to buy a house just to get a residence; The second is to establish a company and obtain both a residence and work permit. In case of obtaining a work permit, it is necessary to spend 183 days in the country according to the law.

Procedures;

  1. A consultant is needed to establish a company, obtain a residence and work permit, because all documents and everything are in Serbian; When the rate of change of laws etc. is taken into consideration, this becomes necessary. A total amount is paid including all translation costs, documents and insurances to be obtained from here, amounts paid to the government and consultancy fee. If you want an invoice, 21% VAT. This price is the price of the establishment of the company with 1 employee and the residence and work permit of the employee. Residence permits to be taken for the employee’s family are not included in this price and if a work permit is requested for more than one person, extra budgeting is made.

Monthly minimum company expenses for active companies, (varies with renewed laws, work capacity, salary arrangements, depending on the agreement with the accountant and taxes).

As for the details of establishing a company; The owner or partners of the company cannot obtain a residence or work permit. So being the owner or partner of a company does not get you these permissions. As an employee of the company you have established, you need to recruit yourself. Persons who are employees of the company (first a director is determined and the salary has been determined by the state as a minimum of 450 € with the new laws) gets a residence and work permit. The family of the employee is not granted a residence permit. Therefore, only the spouse and children of a director and partners who have established the company and are authorized to sign obtain a residence permit.

You can set up a company with unlimited partners, but as I said, partners do not get work and residence permits. The advantage of the partnership is that the partners can automatically recruit themselves and thus obtain a residence and work permit. Every employee pays an insurance fee to the state, such as the SSI fee, which is proportional to their salary.

The document required for the establishment of the company is your passport. You determine your company name for opening to the consultant company representative. The name is questioned by the state. Upon the reply received, the proceedings were initiated. Installation takes a minimum of 7 working days. Then you choose your accountant. To open a bank account and as security, you deposit 3650€ per person. (For family members to be able to get a residence permit, the number of individuals x 3650 € is deposited into the bank account. Since the state determines a minimum security deposit of 10 € per person per day, 3650 € ) This money can be withdrawn after the permits are issued and is re-invested each year when the renewal is made.

  1. For residence and work permit, your white paper given by the Tourist Organization upon entry to the country, the original of your high school/university diploma, the Nostrification of your graduation transcript (transcript) by the Montenegro Ministry of Education, your criminal record with wet signature, your marriage certificate if you are married, a photocopy of your notarized passport. They want the notarized contract of the house you hold in this country, the health insurance you have done until you get the permits, and a health report from a hospital here. Notarized passport, contract, insurance, health report etc. It is handled here with the help of a partial consulting firm. You bring your diploma, marriage certificate, passport and criminal record with you and it will be translated by a sworn translator. It is very important that your diploma is original, because the “graduated” etc document you will receive from high school or university is not accepted. To be accepted, it must be approved by the ministry here, which means extra time and money. When your documents are complete, your residence and work permit will be issued in an average of 21 working days. All documents are also required for your family members, and a residence permit is issued to them on average 10 days after your permit is issued. A fee of 400 € per person is made for the residence permit to be obtained for family members.

If you are going to get a work permit for partners in a multi-partner company; The documents I have mentioned above are required for every person who wants to get a work permit.

As for the citizenship part, the country has not granted citizenship to anyone so far. If you have an uninterrupted residence and work permit for 5 years, you have the right to apply for a long-term residence permit.
